Korea has launched the world's first AI Framework Law to protect people from potential risks associated with AI products and services. However, as the law takes shape, citizens and industry experts are expressing mixed views and concerns.
First, while establishing safety boundaries is viewed as a positive step, many worry there is not enough preparation time. Furthermore, while local companies face penalties for violations, enforcing South Korean laws on foreign corporations is difficult, potentially putting domestic firms at a disadvantage. To address this issue, the government requires foreign companies to appoint a local representative in Korea.
Under the new law, companies must first determine whether their technology qualifies as "high-risk AI." High-risk AI systems significantly impact people's lives and fundamental rights—such as those used in healthcare, hiring, loans, and energy. If classified as high-risk, companies are required to establish internal management systems in advance to mitigate risks and conduct regular checks.
